В Севастополе начала работу межведомственная рабочая группа по анализу состояния соблюдения законодательства в сфере земельных отношений. Первое ее заседание прошло 15 июля в Севастопольской городской госадминистрации под председательством руководителя Главного контрольного управления Администрации Президента Украины Александра Нефедова и заместителя главы города Николая Карпеева.
Группа проверит правомерность распоряжения местными органами исполнительной власти землями оздоровительного, рекреационного, историко-культурного, природно-заповедного и другого природоохранного назначения, землями водного и лесного фонда.
По словам Александра Нефедова «нарушений земельного законодательства очень много». Вместе с тем он отметил, что группа работает в Севастополе «не только для того, чтобы кого-то наказать, осудить или возбудить уголовные дела, а и для того, чтобы собрать максимум информации и подготовить изменения в действующее земельное законодательство, для того, чтобы больше не было таких дыр в законодательстве, через которые можно воровать».
«Сегодня мы для себя “обрисовали картинку” положения дел в Севастополе. Мы отработаем план проверки и начнем работу, – сообщил Александр Нефедов. – Проблема выделения земель – это самая главная проблема. По Крыму поступает очень много жалоб в Администрацию Президента именно на нарушение земельного законодательства. Эти жалобы мы будем рассматривать. Ни одно обращение людей не должно быть оставлено без внимания – это позиция Президента».
Итогом работы группы, по словам Александра Нефедова, станет пояснительная записка, которая будет передана Президенту. В ней будет содержаться информация о выявленных нарушениях, виновных лицах и соответствующие предложения по изменению земельного законодательства с целью предупреждения возможных нарушений в сфере земельных отношений.
В свою очередь заместитель председателя городской госадминистрации Николай Карпеев отметил, что с момента назначения нового состава руководителей исполнительной власти Севастополя, глава города Валерий Владимирович Саратов «занял жесткую последовательную позицию по исполнению законодательства в области земельных отношений». «С первых дней работы под его руководством при городской госадминистрации была создана комиссия, которая на сегодня уже проделала большую работу по ревизии законности распоряжений, изданных за предыдущий период», – отметил Николай Карпеев.
По словам заместителя главы городской госадминистрации, за время работы комиссии установлено, что с 1 января 2008 года по 1 апреля 2010 года было издано около 1300 распоряжений городской госадминистрации, касающихся предоставления земельных участков. Более 1200 распоряжений было издано только за 3 месяца этого года. Большая часть этих распоряжений, по словам Николая Карпеева, является незаконной. Участки передавались из числа земель рекреационного, лесного, водного, заповедного фондов. Передавались земли министерства обороны, сельскохозяйственного назначения.
Николай Карпеев подчеркнул, что все материалы, касающиеся выявленных нарушений в сфере земельного законодательства, передаются в прокуратуру для дачи соответствующей правовой оценки.
«Прокуратура наши материалы исследует, дает им правовую оценку, – отметил заместитель главы города. – В зависимости от фактов наличия или отсутствия состава преступления прокуратура возбуждает уголовное дело в отношении должностных лиц или отказывает в возбуждении уголовного дела. На незаконные решения городской госадминистрации направляет протесты. На основании этих протестов мы издаем распоряжения, которыми отменяем незаконные распоряжения в области земельных отношений, изданные предыдущими руководителями госадминистрации».
По словам Николая Карпеева, целью этой совместной работы госадминистрации, СБУ, прокуратуры и МВД является «возвращение громаде всех незаконно изъятых земель».
Вместе с тем, заместитель главы города подчеркнул, что согласно законодательству процедура изъятия земель осуществляется только по решению судебных инстанций. Николай Карпеев выразил надежду на то, что суды займут принципиальную законную позицию, поддержат городскую администрацию, городской совет, прокуратуру, признают недействительными незаконно выданные госакты на землю и возвратят незаконно изъятые земли громаде Севастополя.
Напомним, межведомственная рабочая группа по анализу состояния соблюдения законодательства в сфере земельных отношений была создана соответствующим распоряжением Президента Украины от 23 июня 2010 года.
Целью работы группы является защита конституционных прав собственности граждан на землю, обеспечения проведения анализа соблюдения законодательства в сфере земельных отношений, а также подготовка предложений Президенту Украины относительно урегулирования проблемных вопросов в сфере земельных отношений.
В состав рабочей группы вошли представители Администрации Президента, Кабинета Министров, Верховной Рады, правоохранительных органов, Госкомзема, других профильных служб и ведомств Украины. Возглавил рабочую группу заместитель Главы Администрации Президента Украины Геннадий Васильев.
